LITIGATION:

Street vendors' challenge legality of by law which allows for impoundment of goods

Phoenix Plaza Street Traders' Association is the applicant in a case that was set down in November 2005 for hearing in the Durban High Court. Street traders are questioning the legality of by laws which allow for impoundment and permanent confiscation of goods which leaves many street traders destitute and prevents them from earning a living. The case could become a constitutional challenge affecting all laws in the country. The application was brought by the Legal Resources Centre.

Beach photographer wins right to carry on earning a living   

Court papers in the judgement granted in the Durban High Court by Judge H Msimang in favour of Khehla Vilikazi, a beach photographer on Durban's beachfront (25/10/2006) . The High Court issued an interdict preventing officials from eThekwini municipality from harassing Vilikazi and from confiscating his cameras. The application was brought by the Legal Resources Centre.
